The following terms and conditions of use apply to use of the wallacecotton.co.uk website. Please read carefully before using this site.

By using this website you are agreeing to accept these terms and conditions. Also note that these terms and conditions are subject to change over time, so it is recommended that that you check these regularly before ordering.

Use of www.wallacecotton.co.uk is subject to the following terms and conditions:

3.1       Access of this site is solely for your personal use. You may not use this site for any commercial or illegal purposes.

3.2       You will not use this site to cause harm to or in any way violate the rights of others.

3.3       We may suspend the site at any time or remove or change any part of the site. We may also terminate your use of the website for any breach of our terms and conditions.

3.4       Access to this site may be limited geographically, and availability of products displayed on this site may be limited to certain regions.

3.5       It is your responsibility to maintain your account and password to access the site, including keeping your password confidential and not disclosing your login or account details to any third party.

The site may include links to other websites in order to provide additional resources or to enhance the user experience. You acknowledge that we have no control over the content, terms or operation of these sites and therefore have no responsibility for third party sites, nor do we necessarily endorse them.

Wallace Cotton (UK) Ltd is registered with the Information Commissioners Office (UK) and the collection and storage of data on our site is governed by the rules of the UK Data Protection Act.

6.1       Your Information

            When you shop on this site you will be required to provide personal information including: your name, mailing address, phone number. This information is required to enable us to deliver orders, deliver catalogues, contact you by email regarding orders or enquiries, and to deliver email newsletters.

6.2       How we store your information

            Your information is stored on secure servers, and may be transferred to or stored in a location outside the European Economic Area (“EEA”). It may also be managed and processed by staff who are located and operating outside of the EEA, for the purpose of fulfilment, customer services and marketing. We will take all necessary steps to ensure that your information is treated securely and in line with our privacy policy.

6.3       How we use this information

            Information that you enter on this site may be used for the following purposes:

  • To enable us to process your online transaction
  • To assist with any customer service enquiries
  • To provide information that may be of benefit to you regarding new products and special offers
  • To send you catalogues
  • To optimise our site in order to enhance the usability to you

6.4       Sharing your information

We may only pass on your information to third party organisations in the following circumstances:

  • To enable the processing of your transaction
  • If we are legally required to, which may include the exchange of information with organisations for the purpose of fraud prevention and/or credit checking purposes

You have the right to request access to the personal information that we hold about you. You also have the right to unsubscribe from any of our email newsletters or posted catalogues. 7. Ordering

When an order has been placed, you will receive an email confirming all the details of the order. This does not constitute order acceptance.

If an item on your order is out of stock or unavailable, we will contact you as soon as possible.

When the order is dispatched to the address details provided, an email will be sent to you. At this time the order has been accepted and the contract for the sale of the products is formed. This contract relates to the products dispatched only. If there are products on the order that are unavailable, we are under no obligation to supply such products.

 

8. Payment and Pricing

Prices are displayed on the site in British Pounds Sterling, and include VAT but not delivery charges. Note that these prices are subject to change from time to time.

If you are ordering from outside the EU, additional charges may be levied at the point of destination which are out of our control and are the responsibility of the purchaser.

Payment may be made by credit or debit card, PayPal or internet bank transfer. We cannot accept payment by cheque. Payment will be processed at the point of order confirmation.

Card payment is in a secure online environment with our trusted payment gateway provider, Payment Express. 

 

9. Cancellation

You may cancel a contract with us at any time within 14 days from the time of order confirmation. Cancellation must be advised by email to info@wallacecotton.co.uk.

If the goods on order have been dispatched, they must be returned unused with all original packaging to our address as listed in clause 10. Note that goods are returned to Wallace Cotton at your expense, unless faulty or the incorrect items sent.

After the returned items have been processed by our returns team, your refund or exchange will be processed. Where possible, payment will be refunded to the same payment method as used for the original order payment. 

 

10. Returns and Exchanges

Wallace Cotton offer a 30 day returns policy, where goods may be returned within 30 days of purchase for any reason, within 30 days from order confirmation. No questions asked.

All items must be returned unused, with all original packaging, in a sellable state. Returning within 30 days will be taken as cancellation of all or part of your order.

Goods are returned to Wallace Cotton at your expense, unless items are faulty or the incorrect items were sent, in which case we will refund the cost of the return delivery.

Once the returned goods have been checked and processed, your purchases will be refunded, however we will not refund any delivery fees paid in the original order.

Where possible, payment will be refunded to the same payment method as the original order payment.

Goods can also be exchanged. If an exchange is requested, we will exchange up to the purchase price of the items on the original order, but we will not refund or exchange the original delivery fee. Additional delivery costs may be incurred for an exchange, for which Wallace Cotton will not be liable.

Please note that products are returned to Wallace Cotton at your risk and we will not be liable for damaged or lost items.

 

11. Faulty Goods 

Goods are classified as faulty if they are received damaged, or where there is a manufacturing fault or where a failure due to a pre-existing fault occurs within six months of purchase. Items that are damaged, as a result of normal wear and tear are not considered to be faulty.

Customers agree to examine their goods immediately upon receipt for conformity with the delivery documents and order information, as well as for any visible defects. If for any reason your item is faulty, you can return it for a refund or a replacement. Please request a return within 14 days of receiving your goods by emailing us at info@wallacecotton.co.uk  and send the faulty goods back to us, within 14 days of receiving the authorisation from us. 

 

12. UK Delivery

Delivery within the UK is free on all orders over £50. For all UK orders under £50 the delivery fee is £4.

Delivery time for mainland UK is from 1 to 3 days. For UK areas outside this, please allow a further 1 to 2 days.

Orders are dispatched with DPD Local, and all parcels require a signature and will not be left at the specified address if not signed for.

At the time of dispatch, you will receive an email and/or an SMS message containing the courier tracking information. Once the order has been collected by the courier, all enquiries regarding the status of the delivery need to be made to the courier company.

Although we endeavour to dispatch all orders as speedily as possible (same day for orders received by 2pm), we are not able to guarantee the delivery times.

We will not be liable for extra delivery costs incurred due to incorrect address details provided at time of order or re-direction to a different delivery address.

 

13. European Orders 

Delivery to the following EU countries carries a flat delivery charge of £10:

France, Belgium, Germany, Spain, Denmark, Netherlands, Ireland, Luxembourg, Austria, Finland, Greece, Italy, Sweden, Monaco, Portugal.

International orders are dispatched with DPD couriers, and can be tracked on dpd.com

Please allow 5 to 7 days for delivery.

VAT is included in all EU orders, and no further taxes or duties will be levied.

Deliveries made outside the EU may incur destination charges which are out of our control and will need to be paid by the recipient on delivery.

14. Limitation of Liability

So far as permitted by English law, and except with regard to death or personal injury arising from negligence, Wallace Cotton excludes any liability for loss or damages of any kind resulting from the use of our site, or the use of or reliance on any content displayed on our site.

Wallace Cotton shall not be liable to you for a breach of our Terms and Conditions if the delay or failure is due to a cause beyond Wallace Cotton’s control.

For any claims arising, our total liability will not exceed the total value of the goods purchased combined with delivery costs.

 

15. Promotional codes

From time to time we may offer promotional codes to be used on the site for discount offers.

The use of these promotional codes is subject to the following additional terms and conditions:

  • Discount codes are only available until the date published
  • Only one discount per customer per transaction
  • Discounts are only to be redeemed on this site
  • Some products may be excluded from the discount code promotions (incl Gift Cards)
  • Discount codes cannot be used in conjunction with any other discount offer
  • Discounts are not refundable

 

16. General

Entire Agreement

These terms and Conditions, along with our Delivery, Returns and Privacy Policy, constitute the entire agreement between you and us.

Severability

Should any clause or paragraph within these Terms and Conditions be ruled invalid or unlawful by any court or relevant authority, the remaining conditions will not be affected.

Waiver

Any failure by Wallace Cotton to exercise or enforce any rights as prescribed in the Terms and Conditions shall not constitute a waiver of such rights in future.

Law and jurisdiction

Any contract entered into between you and us shall be governed by English law. Any dispute or claim regarding any such contract or their formation shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.

Right to vary

We reserve the right to vary these Terms and Conditions as well as any of our policies regarding the use of our website and the contract between you and us from time to time. Use of this site is subject to the Terms and Conditions in force at the time of ordering.
